What this episode is about

Recent whistleblower reports reveal that federal immigration officers may be granted sweeping powers to forcibly enter homes without a judge's warrant, marking a stark departure from existing legal standards and constitutional protections. This explosive disclosure, linked to a memo obtained by the Associated Press, raises significant concerns about government overreach and the implications for individual rights.

Key takeaways

  • Whistleblowers just dropped a memo bombshell; constitutional rights may soon be a historical footnote.
  • ICE's new power grab: entering homes without consent or a warrant—welcome to 'just trust us' policing.
  • Legislative sleight of hand: this memo’s verbal distribution hints the DHS knows it's playing with fire.
  • Imagine hiring agents with no law enforcement background, then handing them keys to your front door—yikes.
  • The May 12 memo smells like desperation, possibly orchestrated by political puppeteers pushing for daily deportation quotas.

Hey everybody, it's Thursday, January 22nd, 2026. I'm Allison Gil and I'm Dana Goldberg and you're watching Beans Talk. All right. Um, we have a very different kind of episode of Beans Talk today. Normally, we go over news stuff we've seen on social media. I had a whole show planned to show you clips of Trump being an idiot in Davos and responses to Trump's Trump being a idiot in Davos. But at the very last moment, um, some incredible like bombshell breaking whistleblower news came across uh my feed uh via the Associated Press who has gotten a hold of this whistle whistleblower report uh through uh Congress which was submitted by whistleblower aid and that is um the organization where Mark Zade works. It is the organization that we have partnered with in the past here uh on well on the Daily Beans but at MSW Media and Beans Talk we've partnered with them to uh help uh they do all this work pro

bono to help protect these whistleblowers. So uh this is um like I have been hair on fire since this report came out and Dana I know you have too. So we're going to go over um we're going to go over this today. This is explosive news. It's from whistleblower raid. Like I said, federal immigration officers are asserting sweeping power to forcibly enter people's homes without a judge's warrant. Now, that's according to Internal Immigrations and Customs Enforcement memo. A memo obtained by the Associated Press given by these whistleblowers. And it marks a sharp reversal of long-standing guidance, not just from DHS, but the Constitution meant to respect constitutional limits on government searches. This is so um wild, Dana. What What do we have here?

Well, first of all, what's amazing is it's an actual they have the actual memo. Either they took a picture of it with their phone or somehow. So, this isn't just speculation on we saw a memo. We They have the press has the memo. The memo authorizes ICE officers to use force to enter a residence. Listen to this. Based solely on a more narrow administrative warrant to arrest someone with a final order of removal. So let's just start with the whistleblower complaint itself. Uh again, this was filed with Congress by the whistleblower aid. Now, the report says, and we'll bring this up for you, whistleblower aid represents two anonymous United States government officials disclosing a secretive and seemingly unconstitutional policy directive. This policy directive authorizes Immigration and Customs Enforcement agents to enter homes and residences without consent in order to conduct arrests and removals without a

warrant issued by a federal judge. That's the unconstitutional part, everybody.

Yeah. So, you know, we've seen these know your rights uh cards and know your rights training where they say make sure they have a judicial warrant signed by a judge and not an administrative warrant.

Yep. That's what this memo is directing uh according to the whistleblowers ICE agents to ignore the judicial warrant. You can do it with an administrative warrant. Um and uh just if you're interested, by the way, in supporting whistleblower it's whistleblower.org/beans. That's our partnership fundraising link. We've had it for a long time because they've been doing this work for a long time. Uh but I want to go back to this report because it goes on to say, and I'll bring this up here for you on the screen. Quote, "By memorandum dated May 12th, 2025, the May 12 memo, acting ICE director Todd Lions authorizes ICE agents to forcibly enter into certain people's homes without a judicial warrant, consent, or an emergency." and B. Specifically, in the May 12 memo, the acting ICE director authorized ICE agents to rely on form I205, which is not a judicial warrant, to enter the residence of an alien subject

to a final order of deportation without consent, including by quote unnecessary and reasonable amount of force. C. While addressed to all ICE personnel, in practice, the May 12 memo has not been formally distributed to all personnel. Instead, the May 12 memo has been provided to select DHS officials who are then directed to verbally brief the new policy for action. Those supervisors then show the memo to some employees like our clients and direct them to read the memo and return it to the supervisor." unquote. So Dana, what does that tell you about?

We're not going to distribute it widely. We're going to give it to you verbally and if you want it, read it

because we don't want a [ __ ] paper trail. We don't want a paper trail. They know this is unconstitutional.

It's this this also says that the DHS knows this is wrong, like I said, and they're covering this up. We're bringing this up for you. Based upon information and belief, newly hired ICE agents, many of whom do not have a law enforcement background, are now being directed to rely solely on form I205, to enter a home without consent to conduct arrests. In fact, our clients at DHS understands that instructors at the Federal Law Enforcement Training Center are directed to verbally train all new ICE agents to follow this policy while disregarding written course material instructing the opposite. Potentially, scores of ICE agents will be emboldened to unlawfully enter private residences which include the private residences of US citizens.

This whole thing is absolute [ __ ] This is one of those reasons. Now, this is in Congress. I really hope that they want to impeach uh Christine Gnome and she ends up going being on trial for this [ __ ] Every single one of these people that know about this memo that put this memo out and I would put all of my money on it that this came from the top. And when I say top, I'm not talking about Trump. I'm talking about Steven Miller. Oh. Oh, for sure. This is a Steven Miller thing. It probably has to do with his directive that they want 3,000 apprehensions a day or whatever.

Um, and you know, looking at at what they've handed in here, I mean, to How many videos have you seen around social media of people using battering ramps to break into people's houses? People asking if they have a judicial warrant.

Um, and and they they don't and they're just like whatever and they just go in. Now we know why they've felt emboldened to break down people's doors, including US citizens, and enter without permission in violation of their Fourth Amendment rights. And of course, we have Kavanaaugh like, "Well, this isn't happening. It's not happening. Nobody's stopping anybody because of the color of their skin or the language they speak." And they have Fourth Amendment rights just like everybody else. And here now we have a memo from May of last year

that was told to ICE trainers. And remember how we went over the other day on the Daily Beans that an AI error meant that people who didn't have law enforcement training were sent to field offices as though they had law enforcement training.

Yep. I also want people to understand and remember when this administration goes away and it will so does the immunity that these ICE agents think that they have, you know, and so this whole thing about not following unlawful orders, I know they were talking about the military. You don't get a pass with this stuff when you're going to be held responsible for the atrocities that are happening in our country right now. You won't have a pass and you won't have protection,

right? And so I'm wondering uh as I'm as I start reading this whistleblower report um under what authority like who drafted a a a a memorandum saying that this was okay. So what do they claim gives them the authority to break down doors without a judicial warrant? Uh that's in this whistleblower report as well. It says here, well, look at this quote. Although the US Department of Homeland Security, DHS, has not historically relied on administrative warrants alone to arrest aliens subject to final orders of removal in their place of residence. The DHS Office of General Counsel has recently determined that the US Constitution, the Immigration and Nationality Act, the INA, and the Immigration Regulations do not prohibit relying on administrative warrants for this purpose.

So, Dana, it's the DHS Legal Council who, by the way, was replaced uh early in Trump's term by a Trump loyalist. remember when he replaced the CIA office of legal counsel so he could get a memo saying the Venezuela incursions were legal and when he replaced the Department of Justice legal counsel so that he could get a memo saying the boat strikes in Venezuela were legal. Well, he did this uh last year uh clearly before May before this memo was handed out saying, "Oh, my new office of legal counsel has said or office of general counsel uh has said that it is legal. We looked at the Constitution and even though all of our training guides and all of our field manuals and all of our policy says that you have to have a judicial warrant, we've decided just right now that you don't need one to break someone's door down. So, this is a Trump loyalist writing a a [ __ ] legal opinion based on nothing. And and

they, by the way, we don't get to see that opinion. It's still covered up. It's still secret. The what's crazy about this in this whistleblower account, there's information in here about the cover up, we'll bring this up, and this says, "Despite the May 12th memo being addressed to all ICE personnel, in practice, the memorandum has only been distributed to select DHS and ICE officials. Furthermore, our clients have been told that the May 12 memo must be treated with unusually strict access control for a document without any confidentiality markings." to which one of our clients was allowed to view the memorandum only in the presence of their supervisor. There were handed they were handed the memorandum allowed a few minutes to review it without the ability to take notes and were directed to hand it back. They were also informed that another employee had been reassigned for contradicting a supervisor about a

different ICE policy. Our client understood their supervisor shared this piece of information as a warning that expressing disagreement with the new arrest policy could result in adverse career consequences. If you fight this, you can be fired.

Of course. Of course there would be retaliation. Um, absolutely. And as as you read that, Dana, I was reminded of what else uh did the Trump administration whisk away into an eyesonly classified server to limit the number of people who could see it? Was it the transcript of the call with Zalinsky that a whistleblower through whistleblower aid went and shared with Congress that led to an impeachment? This

so reminiscent. This whistleblower report is reminiscent of the bombshell nature of that Zalinski transcript. It was edited. Yep. And then Vinman's edits weren't allowed. And by the way, the guy who didn't allow those edits and hid the Zilinsky transcript is a guy named Eisenberg who's in charge of the national security lawyers at the Department of Justice. He's the one

gave him a job redacting the Epstein files right now. Uhhuh. That guy, that particular gentleman is in charge of this. And I I am also curious to find out if his fingerprints are on this office of general counsel memo from DHS as well. It'll be interesting.

It'll be interesting to see. Absolutely. And you know, of course, there was retaliation against those uh who spoke up like you said. It says here, quote, "Together, our clients are aware of multiple DHS employees who faced retaliation for expressing their concerns and/or disagreement with the May 12 memo's policy change, likely constituting prohibited personnel practices. One client is aware of a seasoned government instructor tasked with teaching this new doctrine who chose to resign rather than be forced to teach what they understood to be unlawful.

And Dana, I have to say I am so very proud of some of our federal government employees who are resigning rather than going against their oath. Absolutely. I am too. And we've seen this across the board in many different areas. You know, you got people uh at the CDC, my dear friend, uh who resigned instead of going along with all this [ __ ] saying this, I can't do this. I can't back this anymore. where you've got people in these areas saying, "I'm not going to take I'm not going to uh handle these orders. I'm not going to make this h execute this for you, and I disagree with what you're handing me."

We have people at the uh Civil Rights Division, the DOJ, resigning because they won't investigate Jonathan Ross' murder of Renee Nicole Good. We've got people at the Minneapolis United State uh US Attorney's Office uh saying, "You want me to investigate her partner and and her ties to protests and not the murderer, Jonathan Ross?" We had people resign uh conservative people, as a matter of fact, resign from US attorney's office in the Southern District of New York over the Eric Adams scandal

when they wanted to do that as well. So, like you said at the top of the show, Dana, you might be wondering if they weren't allowed to have a copy of this memo and it wasn't widely distributed. Where are they getting their evidence? Well, believe it or not, like you said, one of the whistleblowers was able to get a screenshot of the entire May 12, 2025 memo. And here, we'll put it up on the screen for you, but it's page one. And that's the page where you can see the second paragraph where it says um what you read from the whistleblower report. quote, "Although the US Department of Homeland Security, DHS, has not historically relied on administrative warrants alone to arrest aliens subject to final orders of removal in their place of residence, the DHS Office of General Counsel, has recently determined that the US Constitution, the INA, and the immigration regulations do not prohibit relying on administrative warrants for

this purpose." But of course, while we have this memo, what we don't have is the Office of Legal Counsel DHS memo granting uh the permission to teach ICE agents who probably have no law enforcement experience because of an AI error

that sent them out to field offices, teach them. It's wild proper warrants. And it's also wild that they're just like, we've recently decided that the Constitution actually doesn't cover this. We don't need to have that. We decided. Who the [ __ ] is we?

Yeah, we have decades of uh, you know, constitutional precedent in the courts and decades of DHS policy and ICE policy that says that we can't do this. Uh, but we've decided here at the Office of General Counsel for DHS that um that the Constitution doesn't say what what you think it does.

And then you can't even Can you show me where that is in the handbook? No, I cannot. In fact, you can look at it from here. Can't touch it. Nope, you can't touch it. Hand that back now. This is absurd. The whole [ __ ] thing is absurd. I I'm so glad this is in the hands of Congress. But at the same time, what's going to happen? Like, are they going to do anything?

Well, they need to call for articles of impeachment immediately. They have been not doing that uh for a lot of things that should have warranted impeachment.

Um but Todd Lions needs to go. Christine Gnome needs to go. Uh, Donald Trump needs to be investigated by a committee for this. And if he was involved in this, he needs to go. Probably Steven Miller, who's the HSI White House uh, advisor. He's the president. Let's just call it what it is.

See, it's true though. Um, they all need to go and there need to be hearings. There need to be 9/11 commission style hearings on this. a government agency instructing their officers to ignore the Fourth Amendment and barge into people's residences, including US citizens without a judicial warrant is just beyond the pale. And I want to thank these whistleblowers. They are anonymous and I know whistleblower aid will do an incredible job to maintain their anonymity. We still don't know as much as Republicans tried to get the identity of the Ukraine perfect phone call whistleblower.

Mhm. Um they we still don't have that because of organizations like whistleblower aid. Again, we help them like raise money uh to do this. You can donate directly to them. It's uh whistleblower.org/beans uh if you want to help them with this kind of work. But I just want to thank the whistleblowers here. Um, you have restored my faith in humanity. We don't often hear about people who are still working for this Trump organization that are blowing the whistle like this, that are calling these [ __ ] out, that are bringing these things to light, bringing them to Congress through the legal means like through whistleblower aid. So, just thank you so much for for being brave uh brave enough to come forward from the Department of Homeland Security itself to bring this story to light. This is a massive massive story, Dana.

Yeah, I am really grateful that there are still people that have stayed in their position and in a sense want to hold true to their, you know, their what they what they promised and to protect the Constitution, but have no problem at this point saying absolutely not. I'm going to I'm still on the inside and I can see what's happening and I'm going to stand up for this. I mean, the courage Thank you. Thank you. Thank you. We still have federal workers that are doing the right things. We have military that are doing the right thing. Like we have people all over the place that are standing up against this administration saying not on my watch. And that's what we need. Everyone if everyone quits and everyone goes away, they just put in all of their people and all of their latis.

And it is just nice to see that we still have people on the inside that are able to try and stop some of this. Yeah. I'm I'm not sure that these two whistleblowers um are going to stay working at Department of Homeland Security. Uh I would have to look deeper into the report for that. I didn't uh get a sense that they still work there from the Associated Press report. They didn't kind of really touch on that,

but they were definitely there uh recently enough to bring this to light today um in toward the end of January. So, yes, thank you uh for for making sure that you are upholding your oath to the Constitution and not a person. Yes.

Um and or or or a or a DHS, Office of General Counsel memo. Um I I it just it um

I feel like I can stand a little taller today. Do you know what I mean? I do. And we have to remember ICE has been around a very long time. It's just never been weaponized like this. This has been completely broken. And I'm not saying it didn't need reform before, but this is not what it was established for, and it's not what it was supposed to be used for. So, I'm hoping we can stop this sooner than later.

Yeah. And we'll we'll keep following uh this report will keep following the DHS appropriations bill that's going through Congress right now, separate from the government funding bill. Uh and you know, we do have to keep in mind that the big ugly bill funds ICE regardless of whether the government shuts down or not. They have this $75 million giant slush fund to continue to do this. But that hopefully with Republicans, enough Republicans grow a spine to recognize that they are trampling on people's Fourth Amendment rights, including United States citizens. Not that to me it doesn't make a difference, but to them it might because they're racist [ __ ]

Uh I think um maybe we might see uh at least some reform before we can get in, route it, and uh abolish it like like it should be. Uh it should be. So

well said. Well said, my friend. Thank you. Thanks everybody. I know this was an odd way to do this show. I know this isn't the way we normally do Beans Talk, but it was just such an important story and I think you're going to be hearing a lot more about it in the coming days and weeks. Um, this one isn't going to go away. So, thank you all for watching. I've been Allison Gil.
