What this episode is about
Former President Trump has announced a lawsuit against the New York Times Sienna poll, claiming it spreads "radical left lies" and reflects poorly on his performance across multiple issues, where he is reportedly facing negative approval ratings. This move is seen as an attempt to suppress perceived unfavorable truths as Trump grapples with the reality of his political standing ahead of the upcoming election.
Key takeaways
- Trump's lawsuit is akin to suing gravity—a battle against numbers that just won't budge.
- A poll lawsuit signals Trump's struggle with reality, as disapproval ratings sink like a stone.
- Threatening lawsuits isn't strategy; it's a stifling tactic to intimidate dissenters into silence.
- Polls reflect reality, yet Trump wants to rewrite the narrative—he's trying to edit a live broadcast.
- When facts go swimming against Trump's narrative, he paddles harder, unaware the tide's against him.

All right, Brian, we got some breaking news. Uh, earlier today, President Trump announced that he is going to sue a political poll. I guess it's like a lawsuit against an object or an equation or something. I don't know. This is not a joke. Trump posted a message. We're going to put it on the screen saying that the New York Times Sienna poll will quote be added to my lawsuit against the failing New York Times and that quote, "They will be held fully responsible for all of their radical left lies and wrongdoing." Uh, this is a truly remarkable level of like petty, thin skin nonsense. But it's actually not his first lawsuit against the pollster. That one was dismissed by a judge.
It was against Anne Seltzer. Yep. In Iowa. Uh but it was an obvious violation of the First Amendment. Uh Bri, all this made me wonder, how's your lawsuit against Survey Monkey going?
Mine is going really well. Proceeding proceeding expeditiously. Good. Qualicks, you're next. Uh okay, so let's dig into why Donald Trump is so angry about this New York Times poll because the numbers are quite bad for him.
Yeah. I mean, yeah. Go ahead. So, so I mean he is underwater on virtually every issue. He's net negative17 on immigration 18 on the economy 19 on foreign relations -29 on cost of living which was an especially important issue during the campaign -44 on the Epstein files. So this guy is underwater on every issue. He is he's upset here that this poll kind of betrays the reality of the situation in very much the same way that you know in also today he also attacked Jack Smith because Jack Smith betrayed the reality of the 2020 election. And so Trump doesn't like when when facts kind of break through um like pierce his bubble of of that he's fusing to his supporters. And so and so in this instance, you know, he's he's he knows that the lawsuit isn't going to go anywhere, but if he has the opportunity to chill any further speech by virtue of, you know, being the president of the United States and threatening a a
billion dollar lawsuit or a trillion dollar lawsuit, whatever, whatever number he lands on this time, maybe the next person who dares come forward with some poll that reflects um the reality of how Americans perceive his agenda, maybe they'll be less inclined to post it. Maybe the next person who wants to say something, you know, criticize him on TV. Maybe the next comedian who has like some ill word to utter about him is going to think twice. And that's the goal of this. These things never succeed in the court.
This one won't bear out. But it's it's really expensive in the process and it's harassment. And you're right. I mean, if you're a pollster and you're thinking, am I going to get like a lawsuit if I have a a sample makeup that is more advantageous to Democrats? Even though that's what I think is going to happen,
especially if it's not as big a pollster or as big an outlet as the New York Times. I mean, there are a lot of smaller outlets. The the anceltzer's outlet like the, you know, out there, like her small Iowa newspaper is not able to shoulder the cost that maybe the New York Times might be able to.
No. And also, you know, yeah, Trump just thinks that he can um say words and make them reality. And you know, sometimes he's good at it. Like Fox News will parrot whatever he says about Greenland or anything else or this poll. But the numbers are bad. Again, Trump's disapproval in this poll is 56%. 49% of people said the country was worse off than a was a year ago. 70% rate the economy unfavorably. Uh when it comes to ICE, 61% of voters, including 71% of independents, said ICE had gone too far and 63% disapproved of how ICE is handling its job. Um and you know, as Dan Fefeifer pointed out in his excellent message box newsletter, like the the Trump 2024 coalition is collapsing in real time. I mean, he's lost all his gains with non-white voters. Uh and it's even worse with young voters. Just gone.
What I think was especially striking about about this whole effort too is I'll read this and it's like it's it's really embarrassing. Like it's it's so embarrassing for Trump, but we have seen so many instances where the guy operates without shame and he's able to do these things that any normal person would would just would just cringe to the ends of the earth about. I mean, him asking Maria Corina Machado for her Nobel Peace Prize so that he can pretend like cosplay as if he won it himself is so cringey and so embarrassing and yet he does it anyway.
You have Caroline Levit who came out yesterday and said in the aftermath of Trump calling Greenland Iceland four times. She's like, "No, he didn't do that. He was actually just saying that Greenland is a place where there's lots of ice." And it's like, man, you guys don't have to debase yourself like this. I mean,
I had the same exact reaction. I saw that tweet from her and I just thought to myself, the day before she was, okay, so she's tweeting this thing like denying reality, saying he said a word that he didn't say. We all watched the video. The day before Donald Trump had gone to the press briefing room and was speaking at the podium for a hundred minutes and said he was only uh his numbers on the economy were only bad because he had a terrible press team basically. So he shits on her one day and then she has to deny reality the next and you're just like why do you do this to yourself?
Yeah, it it can't it can't be worth it. Like you could you you know look there there's a point at which she's got to go home and put her head on a pillow and she's just with herself alone with her thoughts and like has to live in that reality that like she's just a bullshitter to the face of the earth.
You're just like Sean Spicer except minus the dancing with the stars. So we just mentioned these terrible numbers in this poll about ISIS's approval rating among voters. So, it seems like uh Trump saw these numbers, filed off a lawsuit one direction, then in the other direction he sent JD Vance to Minneapolis because who doesn't want to hear from JD Vance,
right? That should smooth over the situation. So, as folks know, I mean, uh Minnesota has been uh the site of this massive ICE law enforcement or the uh immigration enforcement operation. There was the horrible video of Renee Good, a 37year-old mother of three, being murdered by an ICE officer. Thought shot her three times. Um, and then there's been other stories that we'll get to in a second. So, JD Vance did this press conference. This first question is him getting asked about why ICE arrested a 5-year-old.
Are you proud of how your administration is conducting this immigration crackdown here in Minnesota right now?
Well, I'm proud of the fact that we're standing behind law enforcement and I'm proud of the fact that we're enforcing the country's laws. But, you know, you asked a question about this 5-year-old kid. I actually saw this terrible story while I was coming to Minneapolis. We had just left Toledo, Ohio this morning for an economic mess event. And I see this story and I'm a father of a 5-year-old, actually, a 5-year-old little boy. And I think to myself, "Oh my god, this is terrible. How did we arrest a 5-year-old?" Well, I do a little bit more follow-up research. And what I find is that the 5-year-old was not arrested, that his dad was an illegal alien. And then they went when they went to arrest his illegal alien father, the father ran. So the story is that ICE detained a 5-year-old. Well, what are they supposed to do? Are they supposed to let a 5-year-old child freeze to death? Are they not supposed
to arrest an illegal alien in the United States of America? If the argument is that you can't arrest people who have violated our laws because they have children, then every single parent is going to be completely given immunity from ever being the subject of law enforcement. That doesn't make any sense. No one thinks that makes any sense.
Okay, Brian. So, um, you'll be shocked to hear that this was, uh, almost entirely Yeah.
For Mr. Van. So, this is a story about Liam Ramos, who's a preschooler. He and his father were taken into custody from their own driveway. So, the school superintendent came out and did a press conference about this incident and said the following things. Uh, there was another adult living in the home who pleaded with these ICE officers to just let that person take care of the kid. They denied it. So, they arrested this kid. The Liam's brother came home 20 minutes later. they just waited a little bit, right? There would have been someone else there, another family member. And then an attorney representing the family said the family had an active asylum case and they showed paperwork showing that the father and the son had arrived at a US port of entry. So these are people who tried to go through the legal process,
which is the exact thing that Republicans claim they want people to do, want people to do, but JD Van stands up there and is like, "Oh, I'm a father." He like uses his kids as like PR shield then just lies to us.
Yeah. I mean, it it for him for him to put forward the fact that he's got a 5-year-old kid himself only then only then to justify what these officers did, not only that, but then spew a bunch of you know, to to basically absolve himself and ICE really just is the peak of of like depravity in this guy.
What's so frustrating about this press conference, too, Brian, is the whole tone like he's he's sort of like being condescending and say, "Let's take the temperature down, like you know, like kind of blaming local officials." But after Renee Good was shot by ICE officers, Christine Gnome called her a domestic terrorist and JD Vance specifically called her a deranged leftist lunatic or something to that effect. It's like buddy like the the call is coming from inside the house if you're worried about the tone and the tenor coming down. Well, just it's just like the peak of irony, too, where you have these guys whose entire whose entire like ethos is just to in to to ramp up tension and incite more violence to come in and claim, you know, to to basically tell you not to believe your lying eyes and claim that they're the ones that are there to bring the temperature down. This whole operation
is meant to incite more violence. I mean, we you and I are in Los Angeles right now. This whole like what happened in LA is a testament to exactly that. They sent ISC in knowing full well that it would would inflame tensions. When it did, the administration then sent in the National Guard pointing to the fact that tensions had escalated, but those tensions were escalated as the direct result of what they did. And so they keep setting these fires and then pointing to the fact that there's flames as some justification to ramp up enforcement. This wouldn't happen without this administration. The incitement wouldn't happen without this administration. And so again, peak of irony for JD Vance to then come out and decry the incitement of violence when there would be no violence. There would be no incitement without this administration itself,
without this massive deployment of ICE officers. And some another reporter was like, "Well, have you called Tim Walls, the governor, tell him that you're coming here?" And he's like, "No, but you know, if he wants to call me, you know, I'd certainly take the call." It's like, "Okay, buddy. Like giving up the game here. You're just sitting down with your own employees. You don't actually really care what the community thinks at all." Um, he was also asked about this uh Associated Press story that said an ICE memo had gone around saying that ICE officers can enter homes without a warrant. Uh, here's his answer to that.
Yeah. So, I I I saw that story and the story is like so much that I read in the mainstream media, it's missing a whole lot of context and when you appreciate the context, it makes sense. No one is saying, look, there there are exceptions. For example, a crazy exception, if somebody is fired at from inside a house, they don't need a warrant to go inside that person's house. There are very narrow exceptions to the warrant requirement where law enforcement officers don't need a, you know, a warrant if, for example, they're an imminent threat of their lives. But what we've said and what ICE has proposed, what what the Department of Homeland Security really has proposed in the Department of Justice is that we can get administrative warrants to enforce administrative immigration law. Now, it's possible, I guess, that the courts will say no. And of course, if the courts say no, we would follow that law.
But nobody is talking about doing immigration enforcement without a warrant. We're talking about different types of warrants that exist in our system. Typically, what happens, not always, but typically in the immigration system, those are handled by administrative law judges. So, we're talking about getting warrants from those administrative law judges. And then, of course, with other cases, you get judges or you get warrants from a judge. That's very consistent with the practice of American law.
Immigration judges don't sign imig administrative warrants. They're signed by ICE officers. So what the the policy that ICE is putting forward here is that ICE officers can give themselves a warrant to enter your home. Like this is crazy. This can't be constitutional.
So the problem here is that a lot of these ICE officers are kind of taking it upon themselves without getting these warrants signed by judges to enter people's homes. They obviously want to figure out some way to subvert that process and eliminate any oversight onto themselves with those pesky judges having to having to sign those pesky warrants. Yeah. So, and so now, yeah, they're just basically trying to create a new a new standard where they police themselves. And for an administration, first of all, you should never have some agency police itself. But second of all, if ever there was an admin an agency that has proven that it should not police itself, it is ICE. Frankly, the the rot that has pervaded this agency is unlike anything that we've ever seen before. So again, like if there was ever an agency not to be able to police themselves, ICE is proving day in and day out why it should not be them.
Yeah, I don't have a lot of faith in them uh authorizing themselves to shred the Constitution. So frustrating. It's like JD Vance, you know, puts like a more reasonable sounding face on just like a blatantly unconstitutional policy. And and frankly, like look, when I see photos of a 5-year-old kid like kind of being used as bait, you know, to try to arrest his dad or or taken into, you know, ICE custody, like the only word I can think for that is evil. It is just so profoundly morally wrong and illegal. It's just it's truly shocking.
Um, so JD Vance is in Minnesota. Trump was probably flying back from Davos as we're recording this. One person who was also in go Davos was California Governor Gavin Nuome, who has done a really good job, I think, of injecting himself into these stories and kind of being there in real time to try to fact check Trump.
I mean, not not even injecting himself. Trump Trump straight up called him out from from stage and and actually kind of quasi compliment was friendly to him.
Well, that's you know, Gavin always says like uh Trump's pretty nice to his face. It's only like on on Truth Social where So, so uh Nome is at the World Economic Forum in Davos. Um, he was supposed to do this event at something called the Fortune Magazine USA House, which is this like corporate funded venue, but that for the first time this year was recognized as the United States's official headquarters at Davos. But the venue cancelled his speech at the last minute. And here's Gavin Newsome's theory for why that happened.
I was going to speak last night. It was well established event at the USA House after Trump's speech. They made sure that I didn't uh they made sure it was canceled. Any institution of independent thinking is under assault and attack by the Trump administration. You're seeing what's playing out in the streets of American cities. What played out in California, the second largest city in the United States of America. Masked men. Guy Greg Bavino dressed up. It's as if he literally went on eBay and purchased SS Garb. Greg Bravino, secret police, private army, mass men, people disappearing, quite literally, no due process, people dragged in the streets, kids separated from families, knocking on doors, racially profiling American citizens. So, is it surprising the Trump administration didn't like my commentary and wanted to make sure that I was not allowed to speak? Uh, no.
So, strong words there from Gavin Newsome. Uh, the State Department denies that they have the speech canceled. It doesn't matter. Here's the thing about getting your speech canceled. It probably means a lot more people are going to hear about this issue than anything you said in the speech. I think Gavin actually delivered the speech. I think they might have live streamed it or just released it online. But politically speaking, I mean, this is the best thing that could have possibly happened to him.
Totally. There there's a there's a world where I I I have lists like fantasy where if a Republican ever comes on to my show and stops ignoring all of my emails that if they walked off, I'd be like that would be the best thing to ever happen because anytime you make an effort to like censor or silence or or just, you know, take the oxygen away from somebody, it's inevitably going to result in them getting a lot more attention than they would have otherwise. I mean, the Secot story on 60 Minutes was a perfect example of exactly that. If Barry Weiss had just dained to allow that story to play, which by the way it did anyway, um it wouldn't have gotten a, you know, half the attention that it got and yet she decided to meddle with it and now the whole world was talking about it.
Yep. And uh and nothing really changed materially. Correct. Yeah. Uh have you ever heard the Mark Marin interview where Carrot Top Storms out of the hotel?
No. It's great. It's really good. Have you guys ever heard that? It's really good. I highly recommend it. It's pretty incredible. Um, so, uh, Gavin, there you also heard he had some harsh words for Gregory Bavino, you top official.
The crazy thing is like for an administration that's so focused on optics and marketing, if if nothing else, this administration is focused on optics and marketing, the picture of Greg Bavino walking down the street wearing wearing something strikingly similar to like SS garb. either you're so dense that you just truly have no idea and you have no no um no sense of historical precedent or or or it's a purposeful effort to to draw some comparison. I I I'm I'm I legitimately don't know which one it was. I mean, look, you know, it's it's metaphysically possible that it could have been an accident. It's metaphysically possible that it was not an accident. But either way, if the optics here are are to push back against claims that you are acting as the American Gestapo, demanding papers from people on the streets um serving as judge, jury, and executioner against people on the streets, then maybe, just
maybe, do not walk down the street uh in garb that looks like it was plucked right out of 1930s Germany.
Yeah, maybe just get a North Face, you know, probably keeps you warm. So, I'm we're going to put a photo of this up if we haven't already. Um first of all, I'm looking at the coat. It's brand new, right? It's like big gold buttons that are bright and shiny, not a speck of dirt on that thing. It's called a great coat. Um, and it really stands out amidst the other ICE officers. Like, no one else is wearing a great coat. It's just Bavino surrounded by dudes in normal jackets or tactical vests or whatever gear with face masks on, of course. Um, and it is, you know, like officers in the military.
Look who's come around to masks after all this time. And then you know officers back in the day and on both sides of the military wore these giant coats but is like really really associated with the German military under Hitler. And if you don't know that, I don't know, like watch one documentary on Netflix or watch Turn on the History Channel,
watch any movie, watch The Pianist, watch like, you know. Yeah. I mean, again, for an administration whose sole focus is optics. I mean, they have, you know, these these full teams running around running around with ICE officers creating these propaganda videos on a daily basis for no one to know. That that's the part I don't buy that nobody there was like uh quick question here.
Sir, did you get that at an historical auction? Oh, I I misstated one thing. Pavino is uh he works for Border Patrol, not ICE,
but he's been part of these operations. And frankly, I mean, Border Patrol officers have been uh accused of being kind of the worst offenders in terms of abuses of suspects and even American citizens. The system isn't broken. It's rigged. He's had this very aggressive kind of trolly Twitter presence. Then he went to the COP climate summit in Brazil and was I think the highest ranking Democrat uh at that climate event at a time when no one is talking about the climate but uh the climate's getting worse. Now he's in Davos which you know look um it's like the circle jerk of all circle jerks the Davos forum like I don't know.
You were just telling me actually how much you wanted to be there. I've never been. I'll never go. Speaking of circle direct circle of direct,
but like he very very effectively once again made himself the opposition to Donald Trump.
Well, look, I think I think it's smart regardless of your opinion on Gavin Newsome. I know a lot of people watched the Ben Shapiro interview, for example, and were upset at what looked like more deference that he paid to Ben Shapiro in in kind of the same vein that he gave to Steve Bannon and Charlie Kirk. All of that notwithstanding, what we're seeing right now, like this is the moment to audition if you want to be president. Like this is this is the audition. This is the opportunity. Everybody's watching and we need leadership. Like there is a vacuum of leadership in the Democratic party. And and so regardless of who you want to see as president, like this is the time for those people to come out and make the case, not just when it's politically convenient for them to do so or financially convenient for them to do so because that makes it about them.
Like if you're just waiting for the perfect moment because you want to keep a low profile so that you can preserve some degree of of um showmanship when you finally do dane to present yourself to the world like that's about you. But right now there is there is a country and and specifically a party that is desperate for leadership and and so this is the time to show Americans and specifically show Democrats that you're willing to to answer when there's a call. And we've seen some people do that really effectively. We've seen Gavin Newsome put himself out there um not just with what we're seeing right now, but also Prop 50 and and making sure to fight fire with fire in terms of what uh what what they had done with those Texas maps. We've seen Roana, for example, uh come out and put forward uh the you know, co-sponsor and lead the Epstein Files Transparency Act. He deserves a lot of credit for that. But then there
are some people who are just kind of laying low right now and and I think biting time from a from an old school political perspective to make their grand entrance into the race. And it's like, you know, if you can't if you can't be bothered to show up right now when a country is in desperate need of some leadership, then why should we believe you, you know, a year and a half down the line, two years down the line when you try to convince us that you're the leader that we need in this moment?
Yeah. Democrats want candidates to step up and to show up. And I think there you look after the 2024 election um there was I think correctly some analysis that Joe Biden uh really screwed up on immigration and the border did get out of control and it really did drive voters back to Trump and it was a huge problem and we needed to course correct on the policy on the rhetoric all of it. But I think some Democrats over interterpreted it to mean like don't talk about ICE. Don't talk about, you know, the abuses of undocumented people in this country or the way that ICE officers or CBPs uh officers are uh going after American citizens. And they were like, "Oh, let's just talk about the economy. Only kitchen table issues matter." Blah, blah, blah. And it's like, sure, I can read a poll, too. But actually, like, you got to talk about the thing that's happening now. You got to talk about the thing that's tearing
communities apart and really hurting people. And like Gavin saw this himself firsthand in Los Angeles. And I think that inspired him to like kind of take the fight to Trump and stop the appeasement strategy that a lot of Democratic politicians, a lot of international politicians, especially in Europe, have gone with uh with Trump this time around. And like it's benefited him politically.
Totally. I mean, he's leading the field in potential 2028 candidates. And there's going to be a huge there's going to be a huge field um of people who are going to run for president in 2028 on the Democratic ticket. there's going to be probably 15 people who are going to show up in that primary and he's he's putting on full display what works and what the Democratic base is is desperate for hungry for and
a cand candidate like him can say at a at a a debate to come where the hell were you when right like that will be a powerful point
right and so the point here is look if if Nuome isn't your candidate or if Nome is your candidate like everybody should take this as kind of a kick in the ass to show up in this moment because this is like if not now when if if this isn't an adequate opportunity while you have like this rogue lawless uh secret police force going out into the streets and shooting Americans and you know you have a president who's decided to blow up the entirety of NATO so he can invade and annex not just a sovereign country but her own ally like if now is not the time for you to like wake up and and voice your concerns and try to show some leadership I don't know what is
yeah it you know the um we won't delve into the Greenland stuff cuz it's kind old news now, but like you you really did see uh the beginning of what I think is a sea change in how Europe and other world leaders will respond to Trump going forward. Like uh Mark Carney, the prime minister of Canada, gave this blistering speech at the same Davos forum. Basically, it's like the international world order as we knew it is gone, folks. Like we got to course correct. Emanuel Macron, the president of France, pushed back on Trump really hard. there's a lot of other leaders who are still kind of like doing the dance, you know, like appease him publicly, don't contradict him. And it's like, you know what, the reason I think Donald Trump backed off on the Greenland stuff is because he saw that Europe was ready to put in place massive sanctions that would have absolutely tanked the stock market, right? And the stock market, you
know, they have this taco trade like Trump always chickens out, so they never bet against um him being tough for putting sanctions in place. Finally, they got a little squirly and they saw the markets dip 2% and they saw the bond markets get squirly and like that is the only thing Trump cares about money, his rich friends, his own money, his crypto holdings, right? Like that is how you get to this guy and he does not respect weakness. He want he respects strength and people who fight him back and like Gavin Newsome is is one of the ones doing that. You know also fighting back, Brian, you and me on YouTube.
Hell yeah. Subscribe to Brian Tyler Cohen's channel on YouTube. Please subscribe to Pod Save America here on YouTube. Jokes aside, look guys, there's a massive right-wing disinformation machine. If you if you look online right now, like half the people are telling you that the Greenland gambit was the art of the deal. Like some genius moments like, "Oh, so we got the deal.
